These Auction Terms & Conditions apply to participation in online auctions operated by Parcus Gallery. By creating a buyer account or placing a bid, you agree to these terms and to our Privacy Policy.
1. Buyer account
You must provide accurate information, use an email address you control, and be legally capable of entering into a binding contract. You are responsible for activity carried out through your account.
2. Lots and descriptions
Each lot is offered according to its published description, images, condition information, auction period and any stated conditions. Dimensions and colours may vary slightly from their appearance on screen. Buyers should request additional information before bidding when needed.
3. Bidding
A bid is a binding offer to purchase the lot. The system may place bids automatically up to a bidder’s confidential maximum amount. The current visible bid may therefore increase automatically when competing bids are received.
4. Reserve and auction closing
A lot may be subject to a confidential reserve price. If the reserve is not reached, the seller is not obliged to sell. The auction closes at the time displayed on the lot page, subject to any extension or correction required by a technical disruption or the published auction rules.
5. Successful bids and payment
The highest valid bid accepted when the auction closes is the winning bid, provided that any reserve has been met. The successful bidder will receive payment instructions. Any applicable taxes, fees or additional costs will be shown in the lot information or before payment. Payment must be completed within the period stated in the payment request.
6. Shipping, collection and risk
Unless expressly included, packing, shipping, insurance, customs duties and import charges are the buyer’s responsibility. Delivery or collection arrangements will be confirmed after payment. Risk passes to the buyer in accordance with the agreed delivery method and applicable law.
7. Withdrawal and cancellation rights
Any mandatory consumer rights under applicable law remain unaffected. Where a statutory right of withdrawal applies, the buyer will receive the information required by law. Nothing in these terms excludes a right that cannot legally be excluded.
8. Fair use and auction integrity
Manipulative bidding, false identities, interference with the platform, or attempts to avoid payment are prohibited. Parcus Gallery may reject or cancel invalid bids, suspend accounts, or pause an auction when reasonably necessary to protect buyers, sellers or the integrity of the auction.
9. Personal data
Personal data is processed as described in the Privacy Policy.
10. Technical availability
Parcus Gallery seeks to keep the auction service available and accurate but cannot guarantee uninterrupted access. If a material technical problem affects an auction, Parcus Gallery may take a reasonable corrective measure and inform affected users.
11. Governing law and contact
These terms are governed by Austrian law, without limiting mandatory consumer protections that apply in the buyer’s country of residence. For questions, contact robert@parcusgallery.com.
